1. AGREEMENT TO TERMS
These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Learnrooms.org (“we," “us," or “our”), concerning your access to and use of the Learnrooms.org website and any related media channels or applications (collectively, the “Site”).
By accessing the Site, you agree that you have read, understood, and agreed to be bound by these Terms. If you do not agree with these terms, you are prohibited from using the Site and must discontinue use immediately.
2. THE SERVICE
Learnrooms.org provides a virtual classroom marketplace where Teachers can create online spaces for students to interact, share course materials, and attend meetings. We provide the infrastructure for these interactions but are not a party to the specific educational content or agreements made between individual Teachers and Students.
3. INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, the Site, including its source code, databases, functionality, software, and website designs (the “Content”) are owned or licensed by us and are protected by copyright and trademark laws.
Your Content: You retain ownership of any materials, posts, or videos you upload to your virtual classroom. However, by posting content, you grant Learnrooms.org a license to host and display that content specifically to facilitate the classroom's functionality.
4. USER REPRESENTATIONS
By using the Site, you represent and warrant that:
- All registration information you submit is truthful and accurate.
- You have the legal capacity to agree to these Terms.
- You are at least 18 years of age.
- Your use of the Site will not violate any applicable law or regulation.
5. USER REGISTRATION & ACCOUNTS
You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. We reserve the right to remove or change a username if we determine it is inappropriate or objectionable.
6. PROHIBITED ACTIVITIES
You may not use the Site for any purpose other than that for which we make the Site available. Prohibited activities include:
- Attempting to bypass security features or reverse-engineer the Site's software.
- Automated data scraping or using bots to access the system.
- Harassing, threatening, or intimidating other users (Teachers or Students).
- Uploading malicious code, viruses, or "spam" content.
- Using the Site for any illegal or unauthorised commercial activity.
7. PAYMENTS AND FEES
If you are a Teacher using the paid features of the platform, you agree to the fee structure presented at the time of classroom creation. Payments are processed via Stripe. Learnrooms.org takes a percentage of fees charged for virtual classrooms as a service fee. All financial disputes regarding course content must be resolved between the Teacher and the Student.
8. THIRD-PARTY CONTENT & GOOGLE SERVICES
The Site may contain links to third-party websites (e.g., Zoom, Google Meet). We are not responsible for the content or privacy practices of these third parties.
Google OAuth: When you use Google to sign in or link Google services to your classroom, you agree to comply with Google’s own Terms of Service in addition to ours.
9. SITE MANAGEMENT & TERMINATION
We reserve the right, but not the obligation, to:
- Monitor the Site for violations of these Terms.
- Terminate or suspend accounts that breach these Terms or for any other reason at our sole discretion, without notice or liability.
10. MODIFICATIONS AND INTERRUPTIONS
We reserve the right to change or modify the Site at any time without notice. We cannot guarantee the Site will be available at all times due to maintenance or technical issues. You agree that we have no liability for any loss or inconvenience caused by your inability to access the Site during downtime.
11. GOVERNING LAW
These Terms shall be governed by and defined following the laws of New South Wales, Australia. You irrevocably consent that the courts of Australia shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
12. LIMITATIONS OF LIABILITY
In no event will Learnrooms.org or our directors/employees be liable to you for any direct, indirect, or consequential damages (including lost profit or loss of data) arising from your use of the platform. The Site is provided on an AS-IS and AS-AVAILABLE basis.
